LEASING
TERMINOLOGY
Terms used in this paragraph have the following meaning:
• Dry lease - when the aircraft is operated under the AOC of the lessee;
• Wet lease - when the aircraft is operated under the AOC of the lessor.
LEASING OF AIRCRAFT BETWEEN THE COMPANY AND ANY ENTITY
For all aircraft leases other than wet lease-out, prior approval from the Authority shall be obtained.
THE AUTHORITY approval is the responsibility of the Quality Assurance Manager, who is also responsible for all leasing-related communication to THE AUTHORITY.
Distribution of appropriate information about leasing to the operational personnel is the responsibility of the management structure.
Dry Lease-in
A dry lease-in must be approved by the Authority and any conditions being part of this approval must be included in the lease agreement.
The Quality Assurance Manager shall ensure that, with regard to the aircraft that are dry leased-in, any differences from the requirements are notified to and are acceptable to the THE AUTHORITY.
Wet Lease-in
A wet lease-in must be approved by the Authority.
The Quality Assurance Manager shall ensure that, with regard to the aircraft that are wet leased-in:
• The safety standards of the lessor with respect to maintenance and operation satisfy THE AUTHORITY requirements;
• The lessor is an operator holding the AOC issued by a State which is a signatory to the Chicago Convention;
• The aeroplane has a standard Certificate of Airworthiness issued in accordance with ICAO Annex 8;
• Any requirement made applicable by the lessee’s Authority is complied with;
• The Quality Assurance Manager shall organize an audit in order to answer the different points.
Dry Lease-out
An operator may dry lease-out an aircraft for the purpose of commercial air transportation to any operator of a State which is signatory to the Chicago Convention provided that the following conditions are met:
• The Authority has exempted the lessor from the relevant provisions of THE AUTHORITY and, after the foreign regulatory authority has accepted responsibility in writing for surveillance of the maintenance and operation of the aeroplane(s), has removed the aeroplane from its AOC;
• The aircraft is maintained according to an approved maintenance programme.
Wet Lease-out
An THE AUTHORITY operator providing an aircraft and complete crew to another entity, and retaining all the functions and responsibilities prescribed by THE AUTHORITY (and in accordance with Regulation No 1008/2008), shall remain the operator of the aircraft.
LEASING OF AIRCRAFT AT SHORT NOTICE
In case of an immediate, urgent and unforeseen need for a replacement aircraft, the approval required by Chapter 13.2.2 above may be deemed to have been given, provided that:
• The lessor is an operator holding the AOC issued by a State which is a signatory to the Chicago Convention;
• The lease-in period does not exceed the period prescribed by the Authority;
• The Authority is immediately notified of the use of this provision.
